Foreign Fighters, Terrorists and Anyone Caught In Between – Guantanamo Military Commissions and the Distinction Principle

Foreign Fighters, Terrorists and Anyone Caught In Between – Guantanamo Military Commissions and the Distinction Principle

Tue 15 October 2019

17:30-19:00

Usha Kasera Lecture Theatre, Old College

This event will explore the principle of distinction as defined in international humanitarian law and how this impacts a variety of issues including: the obligations of non-state actors in armed conflict; the prosecution of different actors through military commissions; how the distinction principle has changed since the US War on Terror began; how to categorise intelligence and mercenary paramilitaries; human rights breaches linked to detention of individuals inappropriately categorised, etc.

The panel will feature both academics and practitioners, including two of the defense lawyers in the 9/11 military commission case taking place in Guantánamo Bay. Dr Kasey McCall-Smith will chair the event.

James Connell is an attorney detailed to represent Ammar al Baluchi on behalf of the Military Commissions Defense Organization. Mr. Connell began his career as a public defender in Las Vegas, Nevada and Fairfax. Virginia. After moving to private practice, Mr. Connell began to represent people against whom the government was seeking the death penalty. From 2003, forward, Mr. Connell has worked primarily on death penalty cases. His clients have included Darrell Rice (the alleged Route 29 Stalker, falsely accused of multiple murders in Virginia); John Allen Mohammad (the DC Sniper, executed in 2009); and Eddie Bell (whose case was heard in the Supreme Court before his execution in 2009). Mr. Connell first participated in the Guantanamo Bay military commissions process in 2008 and has been engaged full-time in the defense of Mr. al Baluchi since 2011.

Dylan Craig is senior professorial lecturer of International Relations at American University’s School of International Studies (SIS) in Washington, DC, and the author of “Sovereignty, War and the Global State” (Palgrave Macmillan, 2019). His current research projects concern proxy wars, the intermediarization of violence more generally, and the “sovereign interstices” to which these intermediarized forms of violence are adapted. Before joining the SIS community in 2004, he taught colonial and Cold War history at Rhodes University in South Africa.

Benjamin R. Farley is a trial attorney and law-of-war counsel at the U.S. Department of Defense, Military Commissions Defense Organization, where he represents Ammar al-Baluchi, one of the five codefendants in the 9/11 conspiracy case who face capital charges before the military commission at Guantanamo Bay, Cuba. From 2013 until 2017, he served as a Senior Adviser to the Special Envoy for Guantanamo Closure at the U.S. Department of State. A 2012 Presidential Management Fellow, Mr. Farley received a J.D. with honors from Emory University School of Law, where he served as the editor-in-chief of the Emory International Law Review. Mr. Farley has published on topics including sovereignty, statehood, and international humanitarian law in various law and policy journals.

Katharine Fortin is an Assistant Professor at Utrecht University where she teaches international humanitarian law, international human rights law and public international law. She is the author of The Accountability of Armed Groups under Human Rights Law (Oxford University Press, 2017) which won the 2018 Lieber Prize. Katharine has written widely about the framework of law that applies to armed groups in non-international armed conflicts and is an editor of the Armed Groups and International Law blog.

Call for students interested in Price moot

Dear students,

Our Law School will be fielding a team at the Monroe Price International Media Law Moot Court Competition again this year.

The Price Moot Court is a unique competition organised by the University of Oxford focused on contemporary questions of freedom of speech, media law, social media and communications technologies. Traditionally regarded as one of the “grand slam” moot court competitions, the Price Moot gathers students and leading academics and practitioners from around the globe: regional rounds are established in South Asia, Asia Pacific, the Americas, South-East Europe, North-East Europe and the Middle East. The yearly final rounds in Oxford are an incredibly global and diverse experience! This is also an extraordinary opportunity for students to learn about a contemporary and expanding field of law in a practical and fun way, mingling with fellow students from other countries as well as with leading experts: in the past years, judges at the competition have included members of the European Court of Human Rights, the African Court on Human and Peoples’ Rights, the Supreme Court of the United Kingdom, and legal counsels from prominent global law firms and companies such as Facebook and Google who shared their insights with the participants.

The website of the Price Moot Court is http://pricemootcourt.socleg.ox.ac.uk/ and contains lots of relevant information. You may wish to start checking this year’s Moot case and rules at: http://pricemootcourt.socleg.ox.ac.uk/case-and-rules/.

In order to participate in the competition, a team will have to submit two memorials (one each for the applicant and respondent sides) in January and then take part in the oral rounds in Oxford from Tuesday 31 March – Friday 3 April 2020. Please note that, starting from this year, teams from Europe will qualify for the International rounds on the basis of the quality of their memorials.

We are seeking to build up a team of highly motivated, hard-working students willing to commit themselves to this challenging yet surely rewarding experience. You will be working along with your team members and coach on analysing the case, creating your arguments, filing your memorials and finally arguing in front of the judges. A team typically consists of four members although more participants can help with preparing for both the written submission and the oral pleadings. Participation is invited from both LLB and LLM students.

If you are interested in participating, please send an email to Dr Paolo Cavaliere [paolo.cavaliere@ed.ac.uk]. You will be invited to attend a brief interview with Paolo and the team coach Thomas Broderick on Thursday 10th October at 11am in room 2.348, Old College.

If you have any questions in the meantime, please feel free to get in touch with Paolo.

The Edinburgh University Mooting Society would like to encourage all law students to join our society this year.

The Edinburgh University Mooting Society would like to encourage all law students to join our society this year.

Mooting is a form of legal debate, modelled on real life court proceedings, where teams of two present persuasive arguments on a legal issue before a Judge. It’s as close to the real thing as it’s possible to come.

For all 1st year students its also a great opportunity to practice before your contact and unjustified enrichment moot later this semester.

We run two internal competitions every year with one just for 1st years and another for 2nd, 3rd and 4th years.

Mooting is a great skill for any lawyer to have and looks great on your CV. It is also a fantastic networking opportunity and we have an excellent relationship with the Edinburgh Legal community. We have a number of cash prizes to award and we have a great social side too.

We also run a number of talks from academics and practicing lawyers throughout the year.

Membership is just £7 for the year and it’s not too late to join. Simply send us an email with your details or drop us a message on Facebook and we’ll sign you up.

Best wishes

“Social media: friend or foe of human rights?” – René Cassin essay competition now open

The human rights charity René Cassin’s annual ‘Human Writes’ essay competition is now open. This year’s title is “Social media: friend or foe of human rights?”

Social media gives activists a platform for mobilisation. It enables them to hold public officials to account. A campaign can be launched with a few characters and the click of a “post” button.

But it also exposes people to risks. Social media censorship can go too far and threaten freedom of expression. Or not go far enough and allow abuse and human rights violations to go unchecked. So, does social media help to protect human rights, does it threaten it?

Every year René Cassin runs this competition to get people thinking about key human rights issues.

We are delighted that Adam Wagner will judge this year’s entries. Adam is a human rights barrister at Doughty Street Chambers and the founder and chair of RightsInfo, the digital human rights charity. He will be looking for well researched, well argued and well written essays.

1st Prize

  • £100
  • Publication on the René Cassin website (along with other shortlisted entries)
  • Copy of East West Street – Philippe Sands‘ acclaimed account of the Jewish legal minds who sowed the seeds for human rights law at the Nuremberg trials.

Eligibility

The René Cassin ‘Human Writes’ essay competition is open to all. The age of the applicant will be considered.

Deadline

Monday 11 November 2019, 12 noon. Winners announced early December.
